Postponement of Tribunal Investigating Sexual Harassment Allegations Against Judge President

MAKHANDA-The Judicial Conduct Tribunal probing allegations of sexual harassment against Eastern Cape Judge President Selby Mbenenge has hit a roadblock, with the postponement of the proceedings due to witness unavailability on Mbenenge’s side.

The accusations brought forward by Mbenenge’s secretary, Andiswa Mengo, allege unwelcome sexual advances made by the Judge in 2022. The hearing, which was set to hear testimony from gender expert Dr Lisa Vetten, was delayed to allow Mbenenge’s legal team more time to prepare adequately.

In a twist during the proceedings, Mbenenge’s lawyer objected to Vetten’s testimony, citing late delivery of the summary of evidence. However, retired Justice Bernard Ngoepe emphasized the importance of presenting all evidence, even if its relevance is uncertain, to ensure a fair investigation.

Meanwhile, CCTV footage shown at the tribunal excluded a crucial date related to Mengo’s complaint, raising questions about the viewing protocol and approval process. Prabagaran Naidoo, from the Office of the Chief Justice, revealed discrepancies in the handling of the footage request, leading to further scrutiny of the investigative procedures.

The tribunal, set to resume on June 30 – July 11, 2025, faces these challenges as it navigates the complexities of the case against Judge President Mbenenge.
